A child is legally in possession of both mother and father. However, the legal guardian of any child is his father. Every decision has to be made after the permission of the father. The mother also has rights over the kids, but the husband, the legal guardian, can take many important decisions even without the mother’s permission. One such matter where the mother needs the father’s consent is taking the child overseas. For example, if the mother and father are separated, the mother cannot take the child abroad without the father’s permission. Even if the mother has the child’s custody, she has to get the father’s approval before moving out of the country with her child. The next step will be to file a guardian application in the family court. The application will be against the father, and you will claim that it is pertinent to take your child overseas, and the father is stubborn as he has no solid reason for doing so. Your lawyer will help you state all your concerns before the court. The court will then send a notice to the kid’s father so that he is informed of the court proceedings.
Court’s Order:
After listening to the father’s side, the court will release their order. The order will be based on reasons and evidence from both sides. If the court allows the mother to take the child abroad, the father will have no right to stop them.
